Settlement Broken in 5 Million Baht Lawsuit Against Andrew Drummond
The Thai lawyers representing the plaintiffs against Andrew
Drummond have helped prepare the statement below:


This is not a comment about the prior cases brought against blogger Andrew Drummond to block his site in Thailand of libelous articles and to ask for 5 million baht in damages, but a statement of the facts to be reported against Andrew Drummond after he violated the Compromise Agreement which was signed by all parties. The plaintiffs abided by the agreement and dropped the law suit against Drummond and met other obligations, but Andrew Drummond did not keep his word and legally binding agreement.

Andrew Drummond signed this Agreement in order to stop the
legal actions that were instituted against him. This Agreement constitutes what
Andrew Drummond’s lawyer requested the judge to accept if the plaintiffs
Wanrapa Boonsu and Drew Noyes would also accept it. With their acceptance,
Wanrapa Boonsu and Drew Noyes would cancel the 5 million baht lawsuit against
Andrew Drummond and cancel the emergency order to block his Wordpress blog -
which has libelous and false articles admittedly written by Andrew Drummond - which
is against them.
In exchange, Andrew Drummond promised the court that he
would remove the libelous and false content from the website articles that
Wanrapa Boonsu and Drew Noyes cited when they sued him.

further promised the court that he would not report or re-post those articles
again but he did so within a month of signing the Agreement.
Andrew Drummond also agreed in the court settlement he
signed that he would not comment on the case, but he did so only two days after
signing the agreement by posting comments about the case on his blog website.
There are other incidents where Andrew Drummond has violated
this agreement. On July 10, additional legal actions were taken against Andrew
Drummond for violating the court orders in the Comprise Agreement which Andrew
Drummond’s own lawyer helped prepare.
Andrew Drummond signed this agreement in front of the judge,
the court clerk, his own lawyer and the three lawyers for Wanrapa Boonsu and
Drew Noyes.
The Agreement below was duly recorded in Thai at the Pattaya
Municipal Court.
Shortly after signing the agreement, Andrew Drummond
violated the agreement and continued to defy the court orders he agreed to
abide by.
Now the Pattaya Municipal Court has ordered Andrew Drummond
to appear at the Pattaya Municipal Court on the morning of August 25, 2012, for
violating court order agreed to in the Settlement below.
The plaintiffs’ attorneys demand legal actions will be enforced and Andrew Drummond will be held by the presiding judge in contempt of court for violating the court order. Additionally, the five million baht lawsuit and the order to block the hate site will be sought. The same judge had stated that if Andrew Drummond violated the terms of the settlement to cancel the lawsuit against him then the law suit would be reestablished and he would be sent to jail.
